SCOPE

These terms and conditions apply to all purchases made by private customers from MYZU TATTOO. Private customers are people with their place of residence and delivery address in the Federal Republic of Germany, insofar as the goods you have ordered can not be attributed to their commercial or independent professional activity.

CONCLUSION OF CONTRACT

The presentation of my goods and the granting of the option to order represent, on my part, a concrete offer to conclude a purchase contract. By placing your order, you accept the offer and the purchase contract is concluded. You will receive an order confirmation via email to the email address you have provided.

PAYMENT

Payment is made via PayPal, once the delivery is made.

BELATED PAYMENT

If your payment is late, MYZU TATTOO is entitled to demand a default interest of 5% points above the base rate announced by the Deutsche Bundesbank for the time of the order. If MYZU TATTOO has verifiable higher damages due to delayed payment, MYZU TATTOO has the right to assert them.

RIGHT OF RETENTION

The customer is only authorized to exercise a right of retention if their counterclaim is based on the same contractual relationship.

DELIVERY

Delivery is made to the worldwide address specified by the customer.

If force majeure (natural disasters, war, civil war, terrorist attack, pandemic) makes delivery or any other service permanently impossible, MYZU TATTOO has no obligation to perform.

SHIPPING

It usually takes 3-7 days to process an order, after which it will be shipped. The delivery time depends on your location and is estimated as follows:

Europe: 6-8 working days

USA: 3-4 working days

Australia: 2-14 working days

Japan: 4-8 working days

International: 10-20 working days

WHEN WILL I RECEIVE MY ORDER?

It is difficult to predict shipping times. You can track the manufacturing times of my products.

WHERE WILL MY ORDER BE SHIPPED FROM?

I work with an on-demand company that handles assignments with facilities around the world.

WILL THE CUSTOMS DUTIES BE OFFSETTED?

An additional duty and tax fee may apply to international orders.This fee is beyond my control and is set by the local customs office. Customs regulations vary from country to country. Therefore, please inquire directly at the local customs office wheter they levy duties and taxes on your purchases.

MY ORDER DOES NOT ARRIVE. WHAT CAN I DO?

Before you get in touch with me, please help me as follows:

01 Check the shipping confirmation email for errors in the delivery address.

02 Ask the local post office, if your package is there.

03 Check with your neighbors to see if the courier has left the package with them.

If the delivery address was correct and the package was not handed in at the post office or your neighbor, contact me at myzu.tattoo@gmail.com with your order number. If you found a mistake in your delivery address, we can send you a replacement order, but the shipping will be at your own expense.

PRICES AND SHIPPING COSTS

The prices awarded are final prices including sales tax. The amount that is shown at the time at which the binding order is placed, applies. I take care of the shipping costs. I will also take care of the regular costs of the return that arise in the event that you return the goods by exercising your right of withdrawal. If you exercise your right of withdrawal, I will also refund the shipping costs. This only applies, if you hand in the withdrawal form within 14 days.

PRODUCT CREATION

I work with a print-on-demand drop shipper. It has locations all over the world. Depending on where you are, orders will be processed and shipped by the facility that can do this most efficiently.

ORDER TRACKING

You will receive a tracking link via email when your order is shipped. If you have any questions about tracking or your shipment, write us an email at myzu.tattoo@gmail.com.

RECEIVING A WRONG/ DAMAGED PRODUCT

I am very sorry if the product you ordered arrived damaged. To help me fix this quickly, please send me an email with photos of the damaged product, the order number and any other details you have about your order to myzu.tattoo@gmail.com within a week. I will send you a solution as soon as possible!

DEFECT RIGHTS

A product that is already defective upon delivery (warranty case) will, by choice of the customer, be replaced by MYZU TATTOO with a defect-free product or will be repaired professionally at the expense of MYZU TATTOO (supplementary performance). Please know that there is no warranty case if the product was of the agreed quality when the risk passed. A warranty case does not exist in the following cases:

01 in the event of damage caused by misuse or improper use,

02 in the event of damage caused by the products being exposed to harmful external influences (in particular extreme temperatures, humidity, exceptional physical or electrical stress, voltage fluctuations, lightning strikes, static electricity, fire).

RETURNS

RETURN POLICY

My return policy does not cover products purchased in error, so I can not issue a refund for the order. I do not offer returns or exchanges, but if there is something wrong with your order please let me know by contacting me a myzu.tattoo@gmail.com.

REFUNDS

Refunds are only offered to customers who receive wrong or damaged items. If any of these points apply, contact me at myzu.tattoo@gmail.com with photos of the incorrect/ damaged items and I will sort it out.

EXCHANGING ITEMS

All Items are made individually at the moment of order. I therefore do not offer an exchange. If you are not sure which size fits better, check out the size charts. I have one for every item in my shop and you can find it in the product description. 

While it is rare, it is possible that an item you ordered was mislabeled. If so, please let me know within one week of receiving your order at myzu.tattoo@gmail.com. Include the order number and photos of the mislabelled item. I will send you a new one or refund the purchase price.

LIABILITY

01 In the event of slight negligence, MYZU TATTOO is only liable if a breach of essential contractual obligations has occurred. This is limited to foreseeable damage. This restriction does not apply to injury to life, limb and health. MYZU TATTOO is not liable for other slightly negligent damage caused by a defect of the purchased item.

02 Regardless of a fault on the part of MYZU TATTOO in the event of fraudulent concealment of the defect or the assumption of a guarantee remains unaffected. The manufacturer’s guarantee does not represent an assumption of a guarantee by MYZU TATTOO.

APPLICABLE LAW

The contract concluded between you and MYZU TATTOO is subject exclusively to the law of the Federal Republic of Germany with the express exclusion of the UN sales law. The mandatory provisions of the state in which you have your habitual residence remain unaffected.

DISPUTE RESOLUTION

General information requirements for alternative dispute resolution according to Art. 14 Abs. 1 ODR-VO and § 36 VSBG: The European Commission provides a platform for online dispute resolution (OS), which you can find at this address: http://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

CONTRACT LANGUAGE

Contract languages ​​are German and English.

FINAL PROVISIONS

01 Should individual provisions of this contract be or become wholly or partially ineffective or void, this shall not affect the validity of the rest of the contract, insofar as a contractual partner is not unreasonably disadvantaged as a result.

02 Changes or additions to this contract must be made in writing.

SCOPE

These terms and conditions apply to all tattoos to be made by MYZU TATTOO.

CONTRACT

A contract for the production of a tattoo is concluded when the customer orders the design for the tattoo and makes an appointment. The order is proven by the payment of a deposit by the customer. With a down payment, the customer enters into a legally binding purchase contract. The bid also includes the possibility that there are small deviations, typing errors and technical changes compared to our images and descriptions. Cancellation of the contract and contestation are excluded in this case. With the deposit the customer confirms the general terms and conditions listed under AGB STUDIO.

TIMELY CANCELLATION OF APPOINTMENTS

This should be done at least 3 working days before the appointment, otherwise your deposit will be forfeited. If you do not show up for the appointment without prior cancellation, the appointment will be billed in full.

GENERAL VALIDITY
Only people who have reached the legal age can be tattooed. The ID may have to be shown.

I do not tattoo people under the influence of alcohol and / or drugs, hemophiliacs or people with immunodeficiency (HIV). I reserve the right to reject customer requests without good reason, especially in the case of desired political motifs, tattoo designs from another tattoo artist that should be copied and templates that do not allow for a permanent good job due to size or body part.

Photos of the tattoo will be published, the rights for them remain with MYZU TATTOO.

WARRANTY

I am not responsible for any consequential damage caused by tattoos. Entering the studio is at your own risk. With the signed declaration of consent you agree to waive all legal steps against MYZU TATTOO. I do not accept any liability for consequential damage, possible complications or if you do not like it.

PRICE INFORMATIONS

are not flat rates and can only represent estimates. The time it takes to get a tattoo depends on many factors that I cannot predict in advance (for example pain tolerance, skin texture, etc.), so that a binding prediction of the time it takes to create the tattoo is impossible. The total price of the tattoo results from the size of the design, the effort and the part of the body to be tattooed.

DEPOSIT

is usually 100 euros, for big projects 40 % of the total price. A deposit via PayPal is required to book. It serves on the one hand to pay for the consultation, on the other hand to ensure that you will be there for the appointment and last but not least, the effort for the draft. If the deposit has been successfully received, your appointment will be fixed, otherwise your reservation will expire after 3 days. If the appointment is not postponed or canceled later than 72 hours before the appointment, or if the drafts have already been made or other services have been performed, the deposit will be withheld. If the deposit is to be reclaimed for other reasons, only half will be refunded.

PAYMENT

After the service has been provided, payment must be made directly, fully and exclusively with cash. Payment in installments can only be agreed for motifs that span several sessions.

HYGIENE

The tattoo is carried out in compliance with all hygienic regulations, using professional instruments and techniques. Only disposable needles and hygienic articles are used. Information about risks, side effects and subsequent care is being provided. For more information, see the Skincare section.

VOUCHERS

are not transferable and are generally valid for 1 year. They can be purchased in any amount but cannot be paid out.

FINAL PROVISIONS

I reserve the right to change the terms and conditions at any time. When a contract is concluded, only the terms and conditions of the version valid at the time apply. If one clause of these terms and conditions is invalid, the other clauses, as well as the contract itself, remain in effect. If these clauses have not become part of the contract, the content of the contract is based on the statutory provisions.
